Articles of Confederation (1777) - US Constitution (1789)
Declaration of Independece
The Articles of Confederation create a confeeral form of government in
which states had the authority to govern themselves and the national governemtn
could exercise only limited powers.

When problems arose in the economy, The delegates drafted the US Constitution.
This document was ratified in 1789 became the basis for an entirely new form of 
government. A Federal Government

Federal Powers - Enumerated Powers - are powers that the states dont perform.
10 Admendment tells the powers that the state perfomrs.

States have inhereit sovereignty (independence) , that gives them the power to
regulate affairs within their borders.

Police Powers -  states regulatory powers - regulate private affairs, protect or
promote the public order, health, safety, morals and general welfare.

RELATIONS AMONG THE STATES

The privileges and immunities clause - prevents a state from imposing unreasonable burdens 
of citizens of another state.

The full faith and credit clause - Article IV, Section 1 of the US Constitution it assures that the
rights estabished under deeds, wills, contracts will be honored by other states.  Civil only.

SEPARATION OF POWERS

Checks and balances that allows eac branch of government to limit the actions of other branches
Legislative Branch - Congress makes the law, and can veto laws
Executive Branch - responsible for foreign affairs, requires consent of the Senate
Judicial Branch - power to hold actions of the other two branches unconstitutional

THE COMMERCE CLAUSE
Article I Section 8 - Permits congress to regulate commerce with foreign nations and among 
the states.  Under this clause the Federal can superced state laws under this clause.  Ex.
Medical Marijauana  - Federal Pre empts state law.

BILL OF RIGHTS

Adopted in 1791 - 10 Admendments - Protection for individuals against interference by the
federal government  - Limits the Federal and State Governmental Actions
1-10 Admendment.

First Amendment - Freedom of Religion, speech, and press and the right to assemble.
Second Amendment - Right to bear Arms (NRA)
Third Amendment - Prevents the lodging of solderir without owner consents.
Fourth Amendment - Prohibits unreasonable search and seizures of personal property
Fifth Amendment - Guarantees right of indictment by grand jury, and fair payment when property is taken forpublic use, prohibits self incrimination and double jeopardy.
Six Amendment- The right to a speedy and public trail by an impartial jury
Seven Amendment - Right to trial by jury in a civil case
Eight Amendment - Prohibits excessive bail and fines as well as cruel and unusual punishment
NInth Amendment - People have rights.
Tenth Amendment - Powers not given to the Federal go to the State.
All of the amendments rights are subject to JUDICIAL INERPRETATION
Free Exercise Clause - guaranteees that a person can hold any religious belief that she or he wants.
Search and Seizures - The fourth amendment protects the right of the people to be secure in their persons, house, papers and effects. Law enforecement must obtain a search warrant - an order from a judge or public officieal to search . - They must have probable cause -
Self Incremination - The fifth amendment - No person should be compelled to be a witness againgst themself.
Due Process - 5th and 14th Amendment - No person should be deprived of life, liberty, or property without due process of law. (procedural and substantive) Equal Protection - a state may not deny to any person within its jurisdiction the equal protection of the law.
